The Presidential Election Petition Court has thrown out the LP and Peter Obi’s petition against President Bola Tinubu on claims that 25% of the votes in the Federal Capital Territory is required to win the presidential election.
Justice Haruna Tsammani, the lead judge of the five-man panel said Abuja is just like other states, adding that it doesn’t hold a higher status than others in the country.
He stated this while delivering judgment during the sitting of the Presidential Election Petition court on Wednesday, September 6, 2023.
Tsammani held that in Section 134 (1) and (2) of the 1999 Constitution of Nigeria (as amended) stipulates that a presidential candidate must attain or score a majority of votes cast in a presidential election, where two or more candidates are involved, and at least 25% in two-thirds of the 36 States and FCT to meet the constitutional requirement to be declared as duly elected as President of Nigeria.
