Court declines to disqualify Obi, Tinubu from 2023 election 

The Federal High Court sitting in Abuja, declined to disqualify the candidate of the Labour Party, Peter Obi, and the All Progressives Congress candidate, Bola Tinubu from participating in the 2023 presidential election.

The PDP had earlier asked the Federal High Court to disqualify Peter Obi and Tinubu. “in the suit numbered FHC/ABJ/CS/1016/2022, argued that Obi and Tinubu are not eligible to participate in the election unless they do so with their previous running mates — Doyin Okupe and Kabiru Masari, respectively.

“Obi and Tinubu had nominated Okupe and Masari as placeholders to beat the INEC’s June 17 deadline, but following the one month grace period for substitution given by the electoral body, and later the two presidential candidates nominated Yusuf Datti Baba-Ahmed and Kashim Shettima as substantial running mates.

“PDP told the court that both Okupe and Masari are not products of any primary election and as such was not validly nominated by the LP and the APC.

“Meanwhile, in his judgement on Monday, Justice Okorowo held that the suit was not only incompetent but amounted to gross abuse of the judicial process.

“The court held that it lacked the jurisdiction to entertain an incompetent suit and accordingly dismissed it.

He said, “This suit qualifies as one which amounts to an abuse of court process.”
