President Bola Ahmed Tinubu filed an emergency motion to stop the Chicago State University (CSU) from releasing his academic records to Atiku Abubakar.
The magistrate court had on Tuesday given Chicago University 48 hours to release Tinubu’s records to Atiku.
Tnubu’s lawyers however, argued that their client is not willing to lift his privacy privilege, with the ruling also conceding this by using the term ‘non-privileged documents’.
Tinubu on Thursday seek a delay in the implementation of the self-effectuating order directing the CSU to comply with Atiku’s subpoenas till Monday.
“Intervenor asks this court to enter an immediate order delaying the effect of the magistrate’s order, at least until Monday, September 25, 2023, so the court may fully consider both the scope of the magistrate’s authority to issue the order without review and the issue of whether the magistrate’s order was a correct application of the law to the facts presented”.
Meanwhile, the United States District judge, Nancy Maldonado has granted Tinubu’s request to delay releasing his academic records to the Peoples Democratic Party candidate, Atiku.
Maldonado said, “I will have a busy weekend. The issue is of process and rules. I’m a rule person; that’s why I’m a judge. This case is quite involved. I am aware of the stakes. It’s more important to me to get this right”.
